1. Introduction
CustomerCapture247™ (“CC247,” “we,” “us,” or “our“) is a customer-capture and follow-up service operated by WebProgress.Net, Inc., an Illinois corporation located at 1331 W Chase Ave, Chicago, IL 60626, United States.
This Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with the CC247 website, landing pages, lead-capture forms, marketing communications, and the CRM and marketing-automation platform we provide (collectively, the “Services“).
By using the Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.
2. Two Roles: When We Are a “Controller” vs. a “Processor”
Because of how CC247 works, we handle personal information in two different capacities, and different rules apply to each:
- When we act as a Controller. For our own website visitors, prospects, and clients, we decide how and why personal information is used. This Privacy Policy governs that information.
- When we act as a Processor (on behalf of a client). When a business hires us to capture and follow up with their leads and customers, that business is the “controller” of its contacts’ personal information, and we process that information on their behalf and under their instructions. In that case, the client’s own privacy policy governs the data, and our handling is also governed by our services agreement and, where applicable, a Data Processing Addendum. Individuals with questions about data held on behalf of a client should contact that client directly; we will refer such requests to the client.
3. Information We Collect
a. Information you provide to us.
- Contact and identity details (name, business name, email, phone number, mailing address) submitted through forms, appointment bookings, or when requesting a report or demonstration.
- Account and billing information for clients (company details, billing contact, and payment information processed by our payment providers — we do not store full card numbers).
- Communications you send us (emails, messages, support requests, and their contents).
b. Information we collect automatically.
- Device and usage data such as IP address, browser type, operating system, referring/exit pages, pages viewed, and timestamps.
- Cookies, pixels, and similar technologies (see Section 8).
c. Information from other sources.
- Information from advertising, analytics, and lead-generation partners, and publicly available business information, which we may combine with information we already hold.
d. Client customer data (processed on a client’s behalf).
- Where we act as a Processor, we handle the contact and interaction data that a client’s own leads and customers provide to that client (for example, form submissions, phone numbers, appointment details, and message history), solely to deliver the Services to that client.
4. How We Use Information
We use personal information to:
- Provide, operate, maintain, and improve the Services;
- Respond to requests, deliver requested reports or demonstrations, and provide client support;
- Set up, configure, and run capture and follow-up systems, including email and SMS follow-up sequences, missed-call text-back, appointment reminders, and review requests, in each case on behalf of, and as instructed by, the relevant client;
- Send administrative, transactional, and (where permitted) marketing communications;
- Process payments and manage accounts and subscriptions;
- Detect, prevent, and address fraud, abuse, security issues, and technical problems;
- Comply with legal obligations and enforce our agreements.
5. SMS / Text Messaging Consent and Terms
Some Services involve sending text (SMS/MMS) messages.
- Consent. We (and our clients) send text messages only to individuals who have provided prior express consent to be contacted. Consent to receive marketing texts is never a condition of purchasing any goods or services.
- Opt-out. You can opt out of text messages at any time by replying STOP to any message. Reply HELP for help.
- Frequency and cost. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- Client responsibility. When messages are sent on behalf of a client, that client is responsible for obtaining and maintaining lawful consent from its own contacts. Mobile opt-in data and consent are not shared with third parties for their own marketing.
6. How We Share Information
We do not sell personal information. We share information only as follows:
- Service providers / sub-processors. With vendors who perform services on our behalf — for example, our CRM and communications platform provider, hosting, email/SMS delivery, analytics, and payment processing. These providers may access personal information only to perform their functions and are bound to protect it. A current list of sub-processor categories is available on request.
- Clients. Where we act as a Processor, information collected for a client is made available to that client.
- Legal and safety. When required by law, subpoena, or lawful request, or to protect the rights, property, or safety of CC247, our clients, or others.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, in which case personal information may be transferred as part of that transaction.
7. Data Retention
We retain personal information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Client customer data processed on a client’s behalf is retained according to that client’s instructions and our services agreement, and is deleted or returned on request following termination, subject to legal retention requirements.
8. Cookies and Tracking Technologies
We use cookies and similar technologies to operate the site, remember preferences, measure performance, and support advertising. You can control cookies through your browser settings; disabling some cookies may affect functionality. Where required by law, we present a cookie banner allowing you to accept or manage non-essential cookies.
9. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
- Access – request a copy of the personal information we hold about you.
- Correction – request that inaccurate information be corrected.
- Deletion – request deletion of your personal information.
- Portability – request a copy in a portable format.
- Opt-out – opt out of marketing communications, and of “sale” or “sharing” of personal information (note: we do not sell personal information).
- Restriction / objection – restrict or object to certain processing.
- Withdraw consent – where processing is based on consent.
To exercise a right, contact us using Section 13. We will verify your request and respond within the timeframe required by applicable law. We will not discriminate against you for exercising these rights. If your request concerns data we process on behalf of a client, we will forward it to that client.
For residents of the EU/EEA, UK, and other GDPR/DSGVO jurisdictions: our legal bases for processing include performance of a contract, our legitimate interests, your consent, and compliance with legal obligations. You also have the right to lodge a complaint with your local supervisory authority.
For California residents (CCPA/CPRA): you have the rights described above. We do not sell or share personal information as those terms are defined under California law.
10. International Data Transfers
We are based in the United States, and we may process and store information in the U.S. and other countries. Where we transfer personal information from the EU/EEA, UK, or Switzerland, we rely on appropriate safeguards such as Standard Contractual Clauses.
11. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12. Children’s Privacy
The Services are intended for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us personal information, please contact us so we can delete it.
